New alert concerning The misuse of notified body ID

We have received some information at a press conference of Ministry for Innovation and Technology. Herewith we share it with you, as follows:
I am forwarding a warning received from the European Commission about a product of a Turkish Producer. See the attachment.
In view of Articles 30, 33 and 41 of Directive 2010/35/EU (TPED) and Articles 20 and 22 of Regulation (EC) No 765/2008 I am writing to alert the EU market surveillance community, via yourself, to the discovery of the fraudulent use by a Turkish cylinder manufacturer of the identification numbers of two of the UK’s notified bodies – 0086 (BSI) and 0353 (SGS). They have confirmed that the declaration of conformity (BSI) and the stamp being marked on the cylinders (SGS) are being used by the Turkish company without their knowledge.
I have alerted the Turkish competent authority to this fraudulent activity and they have advised that they have mounted an investigation, but as yet it is not known whether any of the cylinders have reached the UK or the EU Member States, or who are the importer(s) / distributor(s). In the UK we are working with our enforcement and market surveillance authorities to ensure that any such cylinders can be removed from the market wherever they are identified.

The Government’s Emergency Measures do not affect the freight transport.
According to Government communication the Government’s Emergency Measures do not affect the freight transport.
Nonetheless, we have learned from several sources that drivers returning from Italy have been stopped and checked at the Slovenian-Hungarian border.
After checking their body temperature, even in case of their normal level, drivers received a resolution that they should be quarantined for 14 days.

ADR/RID1.3-as Modification of domestic regulation concerning safety training according to ADR 1.3
The Minister for Innovation and Technology amended Decree 61/2013 (X.17.) on domestic application of ADR by Decree 20/2019 (VIII.1) (containing certain ministerial decrees on the transport of dangerous goods). The Decree entered into force on 02/08/2019.
Change appeared in training according to ADR 1.3. Without transitional period, ADR demands a definite, 2-year cycle for refresher training instead of the former deadlines (end of the given calendar year). Besides, the interpretation of this legal text was ambiguous from more point of views.
Most of the companies scheduled these trainings until 31/12/2019. So do the safety advisors. Furthermore, due to the current changes of ADR/RID, the security trainings were scheduled in 2nd half of the year.
Practically, this legal change endangers the education of thousands of people in companies.
The authority controls and administrative procedures derived from this can bring further difficulties.
We contacted ITM and Disaster Management in order to clarify the transitional periods’ trainings and for having a suitable interpretation.

Information about Seveso training – 26-28 Nov 2018
Seveso-officer (aka dangerous industrial security officer) trainings (developed in 2005, according to the adult educational law) will be held again for industrial professionals working in business sector. The concerned ones may come in for cost-effective, intense, targeted training by the means of the most up-to-date educational methods (distance-learning, e-learning, in room) in accordance with gov. regulation 219/2011. (X. 20.), Annex VII. point 6.2.

Directive 2008/68/EC on the inland transport of dangerous goods
The Ministry for Innovation and Technology received a letter from EU, in which it was announced that reporting deadline of domestic derogations according to Directive 2008/68/EC on the inland transport of dangerous goods is 5th Nov, 2018.
Thus, when such a required modification in domestic regulation [e.g. 61/2013 (X.17.) NFM] is considered to be a derogation (not only clarification or explanation) under the Directive, the Ministry shall send it to Brussels until 5th Nov.

Summary on General Assembly
The International Association of Dangerous Goods Safety Advisors held its General Assembly on 14/06/2018, in Pécel. The quorum of the Assembly started at 10:30 am. The Presidency thanks all participants.
Firstly, we said goodbye to Mrs. Krisztina Horváth, our office manager, whose conscientious work the Association really appreciated. Our new office manager, Mrs. József Váli, “Andrea” was introduced and welcomed.
Beside the personal changes, the following agenda items were discussed:
1. Election of Chairman (Secretary General Mr. Gyula Tóth), minute taker (dr. Beáta Mankher) and protocol verifiers (Mrs. Zsuzsanna Sass and Mr. Tibor Gál)

Our President, Mr. Zsolt Nagy kept a detailed presentation about successful and fruitful work of the Association in 2017. (Annual Record and Budget Plan can be found on our webpage –http://bte.hu/index.php/hu/elnoeksegi-hirek).
The Resolution of the Control Committee was presented on Public Use Report and Annual Budget Plan of 2018. Both of them were approved. The Report and the Budget Plan of 2018 were accepted by the Assembly with no dissenting votes or abstentions.
After all, Assembly negotiated about amendment of the Constitution, which was postponed due to its need for additional precision and the necessity of renewal of all leader posts (members of Presidency, Control Committee and Ethical Committee).
Therefore the Assembly decided to convene an extraordinary session of the Assembly. The date and time will be announced beforehand.
The Presidency expects the greatest level of participation of members.

(6) The quorum for the General Assembly shall be constituted by the presence of at least 50 % +1 person with the right to vote. If there’s no quorum, the repeated Assembly shall be convened on the same day, but within 3 days at the latest with the original agenda. The quorum shall exist independently from the roll-up.
If there’s no quorum, the Assembly will be convened with the same agenda in the same place by 10.30. We count upon every member’s appearance.

Courses held in April
SEVESO administrator training course starts on 16th of April. The administrator’s main tasks: continuous communication with the authority, following relevant changes in legislation, making reports about major-accident hazards and breakdowns, organizing, specifying, reviewing and assessing measures laid down in internal emergency plan.
IUCLID operator training course will be held on 18th April. REACH is an EU regulation that prescribes companies, manufacturing or importing any chemical substance beyond EU in amounts more than one tonne a year, have registration requirements. For the registration the IUCLID (International Uniform ChemicaL Information Database), a software application system developed by ECHA must be used.

2nd Springtime Round Table with the Authority
The National Directorate General for Disaster Management, Ministry of the Interior (NDGDM) invited our Association’s president, Mr. Zsolt Nagy to the 2nd Springtime Round Table with the Authority. This panel discussion will be held for partner authorities and professional organizations, where information will be given about the authority tasks carried out by Disaster Management in 2017. Further topic of the discussion is to expose the plans and targets of DM for 2018.

ADR Consultation – by Disaster Management Directorate of Veszprém County
The ADR consultation organized by Veszprém County DMD (Disaster Management Directorate) was held on 08/03/2018. On behalf of our Organisation President Mr. Zsolt Nagy and Board Member Mr. István Pataki participated. The main purpose of the event was to get the controlling authority and the safety advisors to get to know each other's viewpoints on the current issues of dangerous goods deliveries. The following participants were present on the consultation: national and county leaders and members of controlling staff from NDM (National Disaster Management), as well as safety advisors working in Veszprém and Fejér County. The total headcount was nearly 30 persons.
The speakers, President Mr. Zsolt Nagy (BTE), Colonel FF, HD Sándor Kozma (Ministry of Interior, NDM, Dept. of Dangerous Shipments) and Lieutenant Colonel FF Miklós Antóni (Veszprém County DMD, Superintendent of Industrial Safety) presented the most frequent problem types that may arise during dangerous goods transportations. After the presentations the audience had the possibility to ask questions about the topics and other relevant issues from the speakers. We could discuss activities (based on knowledge, not on sentencing tariffs), that provide safe environment for shipments.
We considered the consultation successful in agreement with the national and county leaders from NDM We feel that we need to seek the possibility for exchange of opinions between the professional and authority bodies, or, if necessary, even to contrast them, in order to maintain a more predictable working environment.

Amendment of Regulation 25/2014.(IV.30.) applicable to dangerous goods safety advisors
Article 74 of Regulation 55/2017.(XII.27.) includes the following modifications:
Amendment of Regulation 25/2014.(IV.30.) applicable to dangerous goods safety advisors
74. § (1) The second intention of paragraph 2 of Regulation 25/2014. (IV.30.) (furthermore R16) applicable to dangerous goods safety advisors shall be replaced by the following:
„(2) The safety advisor shall pass the test in extending exam from the following subjects:
a) in the case of an extension for new type of goods in a given category of transport sub-sectors: specific knowledge test, case study and oral exam for the new type of goods
b) in the case of an extension for the new transport sub-sector: specific knowledge test and oral exam for the new transport sub-sector and case study of the type of goods in the certificate to be extended
(2) The following parts of R16 shall be repealed:
a) The part of text from third intention of paragraph 4: „ and shall be presented at the request of the competent authority”
b) the complete paragraph 12.

2015 ADR drafting errors corrected ...
Our DGSA colleagues indicated that there’s a printing mistake in P200 packing instruction (ADR2015). In Chart 1 and 2 each “va” special packing provision was incidentally replaced by “uv” for the following UN-numbers:
Chart 1: UN 1202, 1006, 1046, 1049, 1056, 1065, 1066, 1072, 1954, 1956, 1957, 1964, 1971, 2034, 3156,
Chart 2: UN 1013 (2x), 1070 (3x), 1080 (3x).

10 years anniversary of our Association, BTE!

BTE proposals for the national derogations/supplements of ADR/RID/ADN 2017
The National Ministry of Development asked our Association to cooperate by preparing our proposals related to the 2017. changes of ADR/RID/AND if any.
In case of using the derogations according to 68/2016 EC Directive as a base for our proposals, those should be registered by the European Comission till December 2016.

NDGDM Resolution for documentation of trainings according to chapter 1.3- ADR Role based on ADR 1.4 or a position?
During an ADR inspection the competent authority -National Directorate General for Disaster Management (NDGDM)- indicated that they expect to see the ADR role of the participants (loader, filler, etc.) according to chapter 1.4 in the documentation of ADR 1.3 trainings instead of the position (e.g. administrator or warehouse service) by the company - which in fact is a general practice to indicate in such documentation. Several companies and DGSAs claimed that the responsibilities, defined by ADR are not relevant for a perosn but for a company.
Based on our proposal and consultation with NDGDM, they officialy confirmed that in the future no requirement of applying 1.4 responsibilities in the 1.3 training documentation exists.
In order to have a common control practice around Hungary, the Directorate sends out this resolution to each local offices in Hungary.

EASA Meeting Bordeaux (09-10. May 2016)
EASA held its spring meeting in Bordeaux (France) on 09 and 10 May 2016. 16 countries were represented by the delegations, our host was Francois-Xavier Carbonne, Chairman of the French Association (ANCS).
Brigitte Medelec introduced CIFMD system- the responsible organization for training and examination of dangerous goods safety advisors in France.

Information on closing of the border by Röszke
The Inspector General of Industrial Safety announced that the crossing point by Röszke (on the Serbian border)- dedicated as the offical point for vehicles carrying dangerous goods- is closed due to the proclaimed crisis. Any kind of road traffic is prohibited. Based on the bilateral agreement this crossing point was dedicated for all dangerous goods carriages. Considering the fact detailed above, the southern- south-eastern freights need to be assured on alternative directions via crossing points to Romania (Nagylak) and Croatia (Drávaszabolcs) dedicated to vehicles carrying dangerous goods.

XXXII. National Scientific Students’ Associations Conference – BTE Special Prize

Chairman of HAS (Hungarian Academy of Sciences), the Director General (DG) of NDGDM (National Directorate General for Disaster Management, Ministry of the Interior) and the rector of the National University of Public Service awarded our Association (BTE- International Professional Association of Dangerous Goods Safety Advisors) for entry: 'Development of the professional methodological asset system of the Disaster Management in the field of carriage of dangerous goods'
The Awards Ceremony took place in the Marbel Hall of Ministry of Interior on 28th November 2014. The Award was handled to the Chairman of the Association, the Honorary Secretary participated as well. This Award represents teh appreciation of our support and cooperation with the Disaster Management Authority in Hungary.

Awards Ceremony of Disaster Management, 2014
On 01/10/2014, the Awards Ceremony of Disaster Management – Scientific Conference took place in Zrínyi Hall of National University of Public Service, organized by the Institute of Disaster Management.
Adjudicators delegated from HAS (Hungarian Academy of Sciences), NDGDM (National Directorate General for Disaster Management, Ministry of the Interior) and the University valued the applications and rated the followings in Category I. of the Award for each section at 1st place:

- Fire-protection - Dr. Ferenc Kanyó, PhD, lieutenant-colonel
- Industrial Security - Dr. Zoltán Lévai, PhD, ret. colonel
In Category II. of the Award of Disaster Management, IPADSA (International Professional Association of Dangerous Goods Safety Advisors) was assigned to the 1st grade by the jury.

NDGDM conference in Balatonföldvár with participation of International Professional Association of Dangerous Goods Safety Advisors
Three-day training was held for the 2nd time for industrial security superintendents and chiefs of departmental inspectorates, nevertheless, course organized between 19 and 21 of November in Balatonföldvár was the first one, where also leaders from water sector took part. According to this fact, several topics and mainly actual issues were on schedule, the consultation weltered in practical way.
Beside the leaders mentioned above, Nagy Zsolt, chairman of our association – International Professional Association of Dangerous Goods Safety Advisors – presented the important changes of ADR of next year. The leader of dangerous shipment section of NDGDM (National Directorate General for Disaster Management, Ministry of the Interior), Colonel Sándor Kozma made a speech about current issues of dangerous goods transport, having given emphasize to public proceedings and the related professional questions to arise

International Conference in Budapest- Presentation in a highway rest
An international conference of European Experts from Control Authorities for carriage of dangerous goods took place on 12-14th November 2014 in Budapest, Hungary, organized by the National Transport Authority (NTA) and General Directorate for Disaster Management (GDDM) of Hungary.
In the framework of the conference we had the chance to introduce our Association and our activities.

Drivingcamp Hungary - Invitation to a technical training - Draft agenda-25.11.2014.
Last week we have visited Drivingcamp Ltd. in Zsámbék for a professional consultation. Drivingcamp Hungary in Zsámbék is the most modern traffic safety and driving technique centre in both Hungary and all over Central-Europe. The knowledge provided by their trainings helps professional drivers to gain more practical knowledge and experience on the field of carriage in tanks and in the near future for cargo securing as well. The training courses provide all drivers the possibility to learn and practice daily situations- e.g. by cargo securing- with full safety and experience the consequences of non-conformities.
As the final event of the consultation we are invited for a professional presentation on 25th November 2014. Through carriage safety all of us is affected but in the first round we would like to ask application from colleagues who work for companies with a core-competence in carriage in tanks or in packagings, or often train professional drivers.

Invitation from the Association of Rail Safety Advisors of the Czech Republic (ABPZ – Vladimi Zeleny, Quido Kratochwil)
The president of the Czech association of rail safety advisors sent an invitation to us to take part on a professional educational excursion organised in the Czech Republic. The host of the workshop is the company Fosfa in Breclav. We liaised about the participation in Luxemburg, on the last meeting of EASA.
The detailed program is attached for information. The member of our association’s RID workshop, Mr.András Halász from Dunajska Streda (Slovakia) is deputed to take part on the program. Important- Special Guide for handling Bulgarian ADR training certificates
The ADR training certificates issued by the Bulgarian Transport Authority between 01.01.2013 and 25.06.2013. do not meet the requirements of paragraph 8.2.2.8.5 ADR. The mentioned certificates will be covered by transitional provision in section 1.6.3.36 ADR 2015, thus already should be acknowledged until the end of their validity (2018!). To support competent authorities and participants, the Executive Agency Road Transport Administration -Ministry of Transport, Information Technology and Communications published an official Guide that can be downloaded here:
The questionable points are Position 9 and 10(Manual page 9, line 2). If the driver has fulfilled the requirements of Basic and Tanks module, Position 9 contains '2, 3, 4.1, 4.2, 4.3, 5.1, 5.2, 6.1, 6.2, 8, 9'and Position 10 contains '-'. Such certificates are not only valid for carriage in tanks. This deviation cannot be objected by official controls or by the consignee.

Luxembourg Meeting 29 – 30 september 2014 Wecker (Luxemburg), 01.10.2014
The European Association of dangerous goods Safety Advisers, “EASA”, held its general assembly on 29th and 30th of September 2014, in Grevenmacher (Luxemburg), and elected a new executive board.
The new president is Professor Dr Norbert Mueller from the German Dangerous Goods Safety Adviser Association (GGVD), the vice president is the former president Jesus Pellejero from the Spanish/Galician Dangerous Goods Safety Adviser Association (ACONSENA), and the general secretary is Gaston Zens from the Luxemburg Dangerous Goods Safety Adviser Association (VGL).
VGL will shortly host the official headquarters of EASA.
19 Dangerous Goods Safety Adviser Associations from 15 countries in Europe have joined EASA. They represent more than 3000 experts, working as internal or external Dangerous Goods Safety Advisers, whose aim is to increase safety and security on the transport of dangerous goods. Final deadline for designation of Dangerous Goods Safety Advisor- 01.10.2014.
According to Decree 25/2014 (30.IV) the final deadline of DGSA designation is 01.10.2014. According to §3, the leader of the company is bounded to report the data of the designated DGSA to the competent authorities. In case of already existing contracts, according to §14 (1) the necessary data must be retrospectively supplemented.

Guidance on ADR within the framework of NAV-BTE Cooperation Agreement
According to the Cooperation Agreement between the National Tax and Customs Administration of Hungary (NAV) and our association (BTE) our experts have released the 'Guidelines for official control of transports of dangerous goods by road'. The Guidance is available in '.doc' format. It contains updated legal information and intends to support the dangerous goods training for audit staff, considering the requirements and needs of NAV.
The 'Guidelines for official control of transports of dangerous goods by road' serves the security of the transport of dangerous goods and will be a useful tool for training for audit staff.

Multilateral Agreement M265
On behalf of Hungary, Minister of National Development Miklós Seszták has signed Multilateral Agreement M265 (Class 7- Concerning special provision S12), the agreement will be published soon in the Official Bulletin.
The decision arrived in the very last moment, as local authorities have already started official controls of vehicles carrying radioactive material, and their drivers (S12- ADR training of drivers) which already led to formal procedures in several cases.
According to the information of MND, ADR2015 will satisfactorily settle the question of training for drivers, there's no need to take further steps on this field.

Working Group meeting on checks of transport of dangerous goods by road
The 'Working Group meeting on checks of transport of dangerous goods by road' Meeting of 'Working Group on checks of Transport of Dangerous Goods by Road" will take place on 12-14th November 2014 in Budapest, Hungary, organized by the National Transport Authority (NTA) and General Directorate for Disaster Management (GDDM) of Hungary. BTE/HVESZ Dangerous Goods Presentation by Rail Cargo Terminál- BILK Zrt.
As part of our long-term close cooperation with the National University of Public Service, students of Faculty of Law Enforcement- Department of Public Safety- were informed at first-hand about the rules of road transport of dangerous goods and the practical implementation of appropriate, safe loading and forwarding methods by Rail Cargo Terminál Zrt. in cooperation with HVESZ. The subject as such is the part of the education program, related to subject of Traffic Safety.
As Dr. Róbert Major- Head of Department of Public Safety emphasized, the appropriate professional competence must be based on both theoretical knowledge and practical techniques which would be inconceivable without the support of cooperating partners.
Cooperation of the University and our Association will continue, student-groups of the coming semesters will be welcome.

DGSA Expert Consultation in Bonn on 17-18th February 2014
We are happy to announce that the DGSA Expert Consultation in Bonn on 17-18th February 2014 was a great success and ended up in several important results.
The consultation took place in the organization of the German DGSA Association, GGVD.
The conference was launched by Mr. Hubert Glock- chairperson of GGVD-; moderator was Mr. Norbert Müller- responsible for international relations. It brought together 15 associations of 12 countries (D,IRL,GB,DK,NL,LUX,F,E,CH,CZ,PL,H) all around Europe.
The first module of the first day was dedicated to the introduction of national associations and in the afternoon the local specialties of the DGSA system were summarized.
On the second day the focus was on the reorganization of EASA-DG, covering the new head office, aims, services, contacts, homepage, etc.
3 working groups were established related to some important issues for us, like
- 1. Annual report; Report on occurrences
- 2. Trainings (BTE involved)
- 3. LQ and IMDG
The conference was closed with an agreement regarding appointment of the next international consultation that will be held on 29-30th September 2014. in Wecker, Luxembourg.
We would like to express our special thanks to our colleague, Zsolt Páli who represented us in Bonn as the responsible person for international relations.

ANCS (French association of safety advisors) is 10 years old – Paris
We managed to participate on the 10th year birthday celebration of the French safety advisors’ association ANCS in Paris. The invitation was sent by Mr. Francois-Xavier CARBONNE who leads 400 members in the association in France.
We had the possibility to listen to their presentations and meanwhile to present the activity of BTE, and talked about the speciality of the work of safety advisors, examination system and the practice of controll in Hungary. We would thank the warm welcome, great attention and interest and hospitality to ANCS, and organizings of Mr. Guillauma Le Coz. We wish hereby a Happy Birthday to the Association. Special thanks to Mr.Zsolt Páli for taking connection and high-levelled and conscientious work.

Methodological guideline of BTE for controll of dangerous goods (ADR) delivery on roads
Our experts in accordance to the cooperation agreement with National Directorate General for Disaster Management updated the matter of training guideline for professionals controlling the delivery of dangerous goods on roads this year. This issuance third after the others is a periodical, which treats circumstantiality the prescriptions on the changing dangerous goods.
At controlls, but also in the every day work can appear questions, which can not be translate compounding the words of regulations. We tried to call the attention of the affected persons on such problems.
Our experts work on such guideline for RID, ADN and ICAO/IATA, and those will be presented to the professionals of National Directorate General for Disaster Management.
We consider important to take steps to work out the misunderstandable and uncleared professional details for the sake safety delivery and interpretation of consistent regulation.

The French Safety Advisors’ Association (ANCS) will celebrate its 10th years of Birthday on January 23, 2014 in Paris. They invited all the European colleagues to participate in this day, and they are very honored by the presence of a maximum of nationalities. They organize round tables for each country on the theme: Review and training CSTMD / Exemption local / specific / Mission Problems encountered in each country. Proposal for administrative conciliation prepared on dangerous goods delivery safety advisor opinion of BTE
At the most important regulation about the operation of dangerous goods delivery safety advisor is the 2/2002 no.Govermental Regulation („Regulation”) been percuading for 11 years has arisen numbers of need of amending and correcting.
The sufficiencies of the Regulation make uncertainty the situation, practical activity of the involved safety advisors and enterprises. The enterprises bring into focus interpreting the Regulation on the exemptions regularly, and however it is prescribed, they do not employ safety advisor, or employee trained and controlled by advisor. Therefore we recognised concerning to this, that the safety and professional delivery cause problem on many fields.
BTE got thanking the request to express his opinion about the document of „plan of the regulation of the minister for national development in the year 2013 about the dangerous goods delivery advisors”.
The plan was studied by the experts of our association. Making our opinion we relied on the members’ many year experiences and international experiences too, especially on the German regulation, which can be regarded as a competent in the regulation of this field.
We trust to set a dangerous goods regulation which is applicable in practice, can be controlled correctly, and fit for the demand of the profession and the enterprises resulted by the social consiliations.

We’ve got invitation from the German Safety Advisors’ Association to Bonn. We wanted to take the program inviting the European advisory associations in Budapest, but because of lack of competition source, we had to renounce it.

The brochure, named „Dangerous goods annual – 2011” similarly to the first one, treats again two years due to the cyclic renewal of the regulations.
Our material founded on the facts present the most important changes and events of rules and the data concerned to the dangerous goods deliveries. During our work we intended to show the actual information from every main fields. We studied the fields of dangerous goods delivery on roads, rails, inland waters and air, similarly to the brochure issued in 2009. It is a significant change that we asked the authorties involved in the dangerous goods delivery to present their own activity.
In their summarisation it is introduced with high accuracy and of high standard about their tasks, regulatory background, policy, controlling activity, training and examing system registered and supervised by them. Our purpose is to support the professional dangerous gooods activity with our brochure, to help the development of the profession and to serve the social appreciation of experts working for the safety’s sake.
